Who these terms are between

These terms are an agreement between Cadence Leads ("we", "us") and the business that signs up for Self Run Setter ("you"). By creating an account or using the service, you agree to them. If you sign up on behalf of a business, you confirm you can agree for that business.

The service

Self Run Setter is an AI text appointment setter. It texts your leads from your business number, answers from the FAQs you provide, books appointments on your calendar and follows up with leads who go quiet. It works inside GoHighLevel. You choose its mode: On, Review, Shadow or Off. It works by text message only.

Accounts

• Give us accurate information and keep it up to date.
• Keep sign in details private. You are responsible for what happens under your account, including actions by your team members.
• Tell us right away at [email protected] if you think your account has been misused.

Your responsibilities

You are the sender of the texts that go to your leads. That means:

• Consent. You only send leads to Self Run Setter when you have their consent to be contacted by text, collected in a way that meets the law, including the Telephone Consumer Protection Act (TCPA) and state texting laws. You keep records of that consent.
• A2P 10DLC registration. Your GoHighLevel number and brand must be registered for A2P 10DLC (or the equivalent for your number type) and kept in good standing. Unregistered or suspended numbers may not deliver texts.
• Your content. Your FAQs, offers and settings are accurate and lawful. The setter answers from what you provide, so keep it current. Do not include claims you cannot back up.
• Regulated topics. If your business is in health, wellness, finance or another regulated area, you decide what the setter may say and keep advice that requires a licensed professional out of your FAQs.
• Lawful use. You use the service only for lawful purposes and follow all laws that apply to your business and your messages.
• Your GoHighLevel account. You keep your GoHighLevel account active and paid, and you follow GoHighLevel's terms.

Acceptable use

You may not use Self Run Setter to:

• Text people who have not given consent, or who have opted out.
• Send spam, purchased or rented lists, or messages that hide who is sending them.
• Send content that is illegal, deceptive, harassing, hateful or sexually explicit, or that promotes illegal drugs, firearms sales, gambling or other content carriers prohibit.
• Get around opt outs, texting hours or carrier rules.
• Collect sensitive information such as full card numbers, passwords or government ID numbers by text.
• Reverse engineer, overload or break the service, or access other customers' data.

We may pause the setter or your account if we believe your use breaks these rules or puts carriers, leads or other customers at risk. We will tell you when we do.

AI generated messages

The setter writes messages with an AI model. AI can make mistakes. Review mode and Shadow mode exist so you can check messages before they send, and you or your team can take over any conversation. You are responsible for the mode you choose and for messages sent from your account.

Service availability

We work to keep Self Run Setter running, but we do not promise it will always be available or free of errors. The service depends on providers we do not control, including GoHighLevel, mobile carriers and our AI model provider. Texts can be delayed or not delivered. We may change, add or remove features. We will give notice of changes that significantly reduce what the service does.

Fees

Fees are as agreed in your plan. Unless your plan says otherwise, fees are billed in advance, are not refundable, and do not include GoHighLevel fees or carrier and messaging charges. If a payment fails, we may pause the service until it is resolved.

Your data

You own your data, including your FAQs, settings, lead information and conversations. You give us permission to use it only to provide and improve the service for you, as described in our privacy policy. Your lead conversations and contact records also stay in your GoHighLevel account.

Data export

You can ask us to export your data at any time, including after you cancel, by emailing [email protected]. After your account closes, we keep your data for a limited time so you can request an export, then delete it as described in the privacy policy.

Ending the agreement

• You can cancel at any time by contacting us. Cancellation takes effect at the end of your current billing period unless your plan says otherwise.
• We can end the agreement with notice, or right away if you seriously break these terms, for example by texting people without consent.
• When the agreement ends, the setter stops texting your leads. Sections that by their nature should continue, such as fees owed, disclaimers and limits of liability, continue.

Disclaimers

The service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non infringement. We do not promise any number of appointments, bookings or sales.

Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business, even if we were told they were possible. Our total liability for any claim related to the service is limited to the fees you paid us in the three months before the claim arose.

You agree to cover us for claims brought by third parties, including leads and carriers, that come from your messages, your content, your lack of consent or your breach of these terms.

Governing law

These terms are governed by the laws of [STATE TO BE CONFIRMED], without regard to conflict of law rules. Any dispute will be handled in the courts located in [COUNTY AND STATE TO BE CONFIRMED].

Changes to these terms

We may update these terms. The date at the top shows the last change. If a change is significant, we will tell you by email or in the dashboard before it takes effect. Using the service after that means you accept the new terms.
